Safe Firearm Storage: A Critical Step in Protecting Texas Families
Recent data underscores the importance of responsible firearm storage in Texas. In 2021, the state recorded 4,613 gun-related deaths. According to the Texas Department of State Health Services, 55% of firearm deaths in 2020 were the result of suicide, and firearms were used in 59% of all suicides statewide. Because suicide attempts involving a gun are fatal 90% of the time, limiting access to unsecured weapons is one of the most effective ways to prevent self-harm and violence toward others. Research also shows that incidents of mass violence and interpersonal violence often end in suicide.
Texas law is clear about the responsibilities of gun owners. Under Texas Penal Code 46.13, it is unlawful to store, transport, or leave an unsecured firearm in any place where children are likely to be and could gain access. A person may be charged with making a firearm accessible to a child if the child obtains a readily dischargeable firearm and the adult, through criminal negligence, either:
Failed to properly secure the firearm, or
Left the firearm in a location where they knew or should have known a child could gain access.
Penalties for these offenses range from a Class C misdemeanor, which carries a fine of up to $500, to a Class A misdemeanor, which may result in a fine of up to $4,000, up to one year in jail, or both.
To support safe practices, the State of Texas exempts firearm safety equipment from Sales and Use Tax, making secure storage options more affordable for families.
